In case of the sampler, the great "leak" is the TCP based network API (LSCP).

If the sampler was released under GPL3 without the infamous commercial 
exception, every commercial software and hardware product could use the 
sampler without any enforcement to make their sources public or ask for 
permssions or whatsoever. The network API case is neither covered by GPL2 nor 
by GPL3 unfortunately.

We have been in touch with the FSF quite some times, so this has been 
clearified.
