Strictly speaking, Mr. Schwimmer is quite correct in saying that
this is not a "domain name case." However, the issue before this
court (ha, ha) is the means by which relevant information that
can be used to find a web site can be found by search engines,
etc., etc. This case was decided on the basis of several things,
one of which was intent (a good 1st amendment protection,
there!) and secondly likelihood of confusion (the "sucks"
across the Bally logo took care of that). What the case does
suggest, together with an earlier case, the name of which
escapes me at the moment, is that whatever comes after
.tld/ is not to be considered -- I'm obviously paraphrasing
here. All you good technical types might then put your
heads together to see whether any of this might provide
a clue as to how to obtain TM - DN compatibility.
