Sorry I've taken so long getting back to you, but I've been away from my
computer and had trouble finding info on mondial trading( the ones pushing
earth.com for using the word earth). Then Tony Sanders got in touch and said
that it looks like they would be backing down. Anyway they did.

Hello from Tony Sanders, operator of the domain earth.com

  I have good news,

Today my lawyers informed me that Mondial Trading Company had dropped
the lawsuit on March 5th (they just got the paperwork today, 3/12).
  Mondial's motion was:

  NOTICE OF DISMISSAL

Plaintiff, Mondial Trading Co., hereby dismisses the
  subject action without prejudice.

  It's online here:
  http://www.earth.com/underfire/dismissal.txt

This means that it's over - at least for now (they could
refile but it doesn't look like that was their intention).

I would like to again thank Bret Fausett and Diane Cabell
  for representing me.

And a big Thank You to all those who wrote letters of support.

I'll let you know if anything changes.

Always nice to see the bastards back down.
