In a nutshell, you have the whole net-governance debate: can
multiple states grasp that they will need to be consistent, and so
work together -- or does a central father figure have to sort it out for
them?  Which is more likely to inhibit innovation (e.g. a distributed
network that automatically translates terms and conditions from
one set to another ;-))? Which is most likely to happen, and why?

The problems are even worse internationally.  Much has been
coordinated through ILPF, UNCITRAL, and OECD.  See the useful
materials at www.ilpf.org, especially the survey.
