  Kent, I think you may be wishing for something that may or may not
occur.  In any event it need not occur at all.  However if such a
situation should occur you need to review your facts a bit closer.
First of all, IOD did not lose they withdrew.  BIg difference right off the
bat.
Second, IOD both misfiled and filed in the wrong venue.  If they are
wise the next time around they will file in the 1st US district court.
Third, the piss ant lawyer that IOD used was woefully inadequate.
Again hopefully they will seek much better legal council in the future, should
that future occur...
