It's the real or initial ICANN Board that has to do that, Bret. The
present board is only the interim board. They don't have to follow
the bylaws. Or, if they are the initial board (not altogether clear
from the bylaws), they can change the bylaws, so that, if the bylaws
say that they don't have authority to make policy decisions without
consulting the DNSO, they can alter the bylaws so as to give
themselves that authority, unless of course they don't have the
authority to change the bylaws, which depends on whether or not they
are the initial board.

Is that clear, now?
