  Dave, sorry but you don't know what you are talking about.  The fact
the Bode lacked standing, in in fact that there was not sufficient merit
on THAT basis of the complaint.  Now, pgMedia may be a different
story in their appeal as pgMedia DOES have standing as they are
a competitor to NSI.

  True, but those arguments were not considered anywhere strong enough for
the judge panel to rule in that direction.
