Chris and all,

Mr. Ambler makes a very good point and this point was elaborated to a degree
at the Berlin meeting, but as usual Esther Dyson attempted to sweep
the idea of any gTLD constituency under the rug with here comment to
Riceard Sexton, "Esther Dyson: would prefer to see constituencies go broader in order to help interests fit  in. You should be in the constituency in which you have the strongest interest.
Richard Sexton: that would be the gTLD constituency.
Esther: you aren't one yet. "
The above is an excerpt taken from:
http://cyber.law.harvard.edu/icann/berlin/archive/open2.html

The ICANN Interim board has done everything it can to discourage and even
attempt to prevent true competition form occurring with avoiding and even
denying participation systematically of any REGISTRY's groups from free
and open competition and representation in the ICANN process.  This would
be a direct violation yet again of the principals of the White Paper and the ICANN's
own bylaws.

Christopher Ambler wrote:

It is the position of Image Online Design, Inc. that the refusal to
admit prospective registries to the gTLD constituency, the very
group formed to represent its interests, constitutes a deliberate
attempt to exclude prospective registries from participation in
the DNSO. Policy decisions reached by the DNSO relating to
new registries, without the direct participation of prospective
new registries in their capacity therein are questionable, at best,
and most likely actionable by the excluded businesses.

The results, therefore, are constrained to a very narrow set
of possibilities. While it's obviously not too late to change this
situation, action is currently being taken as a result.

Christopher Ambler
