The bylaw excerpt you quoted explicitly grants the ICANN Board the authority
to determine whether or not to recognize constituencies.  It is reasonable
to assume that the appropriateness of would-be constituencies' membership
criteria will be a major factor in its decisions.  Otherwise, I could
organize a "John Reynolds constituency", claim that I followed the Bylaws in
doing so, and demand recognition.
