Bret and all,
This is one of those rare occasions that Bret is absolutely
correct. It appears that the client (ICANN/ISI) has not properly
counciled it's own legal council, namely Joe Simms properly,
as well as the law firm that Joe Simms represents. It would be
extremely advisable in the future for them to do so and I would
personally request that the Jones & Day law firm take Mr. Simms
aside and give him some proper procedural instruction in these
matters as well...
Such behavior on Mr. Simms part is beneath contempt in his
capacity.
