William and all,

This is a point that Kent seems to have missed.  If Kent can show
previous use of a HIS .WEB tld in commerce than he may have a legitimate
claim, as would CORE, should they have a previous use of .WEB
in commerce.  Weather that use is on a private network is not
consequential here.

My understanding is that Chris Ambler at least has a SM on .WEB,
I am not sure that he has a TM on .WEB.  However, according to
existing TM law, if IOD has previous use of .WEB in commerce it
is incumbent upon IOD to defend that mark as a common law
Mark.  Otherwise it will be considered abandon after a given amount
of time...

My feeling is here that CORE is going to see if IOD will be defending
it's claim either way....   The gloves are off folks!!!  I could sell tickets to
this one!!!  >;)   It is a dog fight now!!!

I wonder where Kent got his legal advice on this situation?  Could it
be that Kent is playing Paten Atty.?  I hope the Kent is not thinking
of doing so, as I am keeping this particular set of responses in
a VERY special place, for potential future reference/use.  To give
legal advice without a license, as Kent is doing, is a violation of
several federal and state statutes.

I believe CORE may have misused the trademark law here.

Unlike IOD, CORE is not using these TLDs in commerce in any way.
