Dear Mr. Bliley,
I have evidence sufficient to convince any judge or jury that ICANN
is neither open nor transparent nor accountable; that it has not
arrived at any of its policy decisions by a process resembling
community consensus; that its board of directors was chosen, not
through a random selection process as they claim, but intentionally
and specifically to represent certain special interests; that no due
process has been followed in ICANN's decision-making; and that,
contrary to the protestations of its board that it represents the
will of the Internet community, it represents only the will of the
individuals and organizations that created and control it,
principally ISOC and CORE.
Rather than send this evidence and briefing to you and the Commerce
Committee, however, I prefer to submit it to the Department of
Justice, in the form of an official complaint against ICANN, ISOC,
and CORE for anticompetitive activities violating the United States
antitrust laws. I will, however, forward a copy of that complaint to
your committee when it is sent to the Justice Department, and will
make available to you whatever of those materials you may wish to
have.
