 regulate online speech, the ACLU is challenging the
 New Mexico law on the grounds that it violates the
 Commerce Clause of the US Constitution."

also....

"The New Mexico law, which employs much of the
  same language as the Communication Decency Act
  of 1996 (CDA), calls for fines and jail time for
  violators. Following the CDA's passage, the Supreme
  Court ruled that many of the Act's provisions were
  unconstitutional."
