In building a TOS I was hoping to avoid the "delete or refuse to
register any domain for any reason" type of phrase. So my concern was for
any liability I might have in leaving out such a phrase were someone to
request something like coca-cola.here for instance. I think the .here
will be particularly susceptible to this type of thing.
On the other hand, if I take it upon myself to make such subjective
decisions then I would think it would lean against us if there were a
legitimate trademark we might miss as at that point we might be construed
as accepting all those determinations as part of our responsibility.
