ICANN Proposal to the U.S. Government to Perform the IANA Function
(relevant to Purchase Order No. 40S8NT067D20 [NTIA/ICANN], approved
2/9/2000), Section 3. Personnel, Subsection b. Louis Touton, states:

"During the last 20 months, Mr. Touton has handled legal aspects of
several matters concerning the IANA, including review and
conciliation of disputes involving delegation of country-code
top-level domains."

Indeed, Mr. Touton is undoubtedly the engineer of the .pn
redelegation.

However, Section 12.5 PERFORMANCE EXCLUSIONS of Purchase Order No.
40S8NT067D20 (NTIA/ICANN) states:

  "The performance of administrative functions associated
with root management does not include authorizing modifications,
additions, or deletions to the root zone file or associated
information that constitute delegation or redelegation of top-level
domains."
 
Has Mr. Touton thus violated the contract for performing the IANA
function as soon as it was signed?
