In my experience, this is a very good case for why it is a good idea to stay away from folders and use metadata on the list/library, makes it much easier to get to later. If the documents are grouped by columns instead of folders, you can then easily perform the function that you need by using the CQWP without using CAML.

To embed your own CAML code you need to export the CQWP, modify the .wepart file (QueryOverride property) with your own CAML and then re-import the .webpart back into the gallery.
