Bella - the whole purpose of Section 1982 (in my limited understanding!) is 
that it puts the fear of God into people who should - and often do - know 
better. The city of Stuart is a prime example - they bailed, rather than face 
this guy in court, because they knew they were wrong.
There are all sorts of laws on the books on land which permit a city and a 
neighbourhood to deal with an irresponsible neighbour, one who's home and 
property are a disgrace. There is no reason similar laws, dealing with a 
specific situation, can't be enacted for marine situations. Right now, it's as 
if city council is saying, well, your neighbour has a junk car in his yard, so 
no one in the city can have a car in their yard. It's ridiculous, but who 
expects a pol to use his intelligence when there is an easier way? 
The problem for those of us on the water is that we don't vote locally in many 
cases, we're a decided minority and yes, there are some eccentric individuals 
amongst us who eschew normal modes of living. We're a handy target.
In my case, the maple leaf on my stern resolves most problems - I'm clearly a 
transient, on my way shortly.  Still, the whole issue affects me and yet, I 
have no way of fighting back, unless I support those who DO have a way, by 
virtue of being citizens of this great country. 
That's why I researched sec. 1982, albeit I didn't find the idea myself - that 
came from an Irish American, Finnbar Murphy, in Eau Gallie. Some of you know 
Finn I expect.
In any event, we now have Naples as a precedent, and we can point to 
Stuart...now it's simply a matter of fighting off the FWC I guess, before they 
get their oar not just in the water but stuck in the bottom.
