I could see no guards on the test that would prevent it from failing when run on a JDK earlier than 1.5 or when the user-specified parser does not support xinclude (I'm assuming the JDK 1.5+ bundled parsers support xinclude). The configurator already supports entity reference as a mechanism for modularizing configuration files and the bug report and unit tests do not test any functionality that is not already present and supported.
