Conference Water Rights Conference March 21, 2003 The Environmental Law Practice Group and Colorado
Chapter present: Greetings! The Federalist Society will host a water rights conference in
Denver, Colorado on March 21, 2003. The order of events will include: OPENING REMARKS: WATER WARS The ongoing debate over the allocation of the waters of the
Colorado River provides an excellent case study illustrating the
intensity of the federal-state-interstate struggle over shared water
rights. Representatives of the U.S. Department of the Interior and the
State of Colorado discuss the tensions created by competing use demands
and the impact of that struggle on economic development. PANEL DISCUSSIONS: State and local law has traditionally governed the
allocation and use of surface water. However, the federal government has
expanded its role through various means, including legislation such as
the Clean Water Act and Endangered Species Act. Which set of rules,
federal, state, or local, should govern? Which government has the
Constitutional authority to establish dispositive rules governing this
invaluable resource? Discussion will iclude interbasin water transfers,
instream flow requirements, and the Klamath Basin. WATER PROPERTY
RIGHTS AT RISK? As the population of Western States increases, and the
surface water supply remains constant, or even decreases, can the law and
the courts be used to upset established property rights in water?
Discussion will focus on how developments in the recent caselaw may
impact states', individuals', and tribes' water development and existing
water rights. The panel discussion will also include the evolving
interpretation of the federal reserved rights doctrine, the Winter's
