You mean do this only in the case of an older kernel version?  If so,
that seems fine...  it's just that that is permanent code for a both
unlikely and temporary case.

So if I were an ltp maintainer I'd say no, bc I wouldn't want to
maintain anything which was any more complicated than it needed
to be.  But I'm not, and from my pov both ways should properly
report failures, so I'm fine with either way.
