Because that panel isn't Gnome's, even when they look the same.
But OSes are not intended to release a thousand themes to please everybody. It's like trying to please all with food, music or sex. I can tell it, people asked me for 8 different combinations of Box theme for Lubuntu. And if possible 14 icon colours variations.
I'll be happy if only main theme works as expected, and I'm doing my best, trust me.
And I love cynicism, it's the salt of life ;)

choices of color-schemes (two) available in Ubuntu Unity, and no

Also, I have not seen the black bar issue yet on the machines I am
using. I do like that Firefox has finally caught up with
Thunderbird's UI.
