It looks like FuzzyQueries are case sensitive by design (c.f. http://jguru.com/faq/view.jsp?EID=538312). However, I am wondering if Fuzzy Queries really ought to be case-sensitive. They are supposed to be 'fuzzy' after all. I think I'll apply your diff int he next few days, unless somebody disagrees before that. Now that I think about it, the same change should maybe be applied to Prefix and Wildcard queries.
