Justin Wells is some guy living in Canada. The ASF is a non-profit
organization that is legally incorporated.
I have a problem with giving control to an unstable individual who makes
irrational decisions.
I don't have a problem with assigning something to a well known stable
non-profit organization.

Yes. Forking is acceptable. It is also acceptable with the GPL/LGPL.
