Things like this are normally better put into a bug report on savannah to prevent them getting lost between all the other mails on this list.

As far as I know there can be *no* racing conditions since only one thread may be active! So it does not matter if the packet is first sent or first put on the queue, the response packet will not be processed before tcp_output returns, anyway.
