Just to clarify, my understanding is that the incompatibility only
applies if OpenSSL is not part of the operating system's distribution.
I think that OpenSSL comes with most unix systems. Even when the
incompatibility applies, it is only in regard to distributing a binary
file. It is always acceptable to build and use your own.
