This has been done on purpose, although I am not sure about what we
should really do. The LaTeX companion states that using \footnote in
lists gives problems (more specifically, when you add enumerations
inside of these lists), and so suggest to use
\footnotemark/\footnotetext for footnotes in lists. However, this has
the drawback you mention for lists which span over several pages. I am
not sure what is the right fix for that, though.
