I think I have found it out: It must be called after babel. And futhermore to be able to use this, also arabic has to be loaded for babel when \TOClanguage{farsi} is used.
Both is implemented in the patch.
OK. I will prepare a clean patch for all these topics except the issues that are related to Arabic
When you have tested the TOClanguage and the additional arabic call, I could also provide a clean patch out of mine that don't touches Arabic.
