Why not get convertDefault.sh to copy the eps file someplace so that you can test this file at your leisure?In the end I have done the following if anyone has these problems.
I think there might have been
another misunderstanding as well. I am converting the approx-pic
latex file to an eps to be included in a lyx document.
Why? Why not include the latex file and then run latex over the combined file?
Anyway, that's a side issue.

a) used dvips -o test.ps (without the -E option)
b) used ps2ps on it
c) used emacs on the resulting ps file to fix the bounding box (you can get the numbers from gv)
I still don't know which app has the problem or whether it is really something wrong with the latex file :(
