sorry, was to fast. If I use your proposal, it says:
LaTeX Error: No counter '1' defined.
\setcounter{\thechapter}{9}
Your command was ignored.
Type I <command> <return> to replace it with another command,
or <return> to continue without it.
so I stick to my way
