It really depends on whether or not the employee in question can make
that determination and authorize/provide a replacement on the spot.
Even if not, if you had your phone for a year but are still unable to
get an upgrade, the technology is so much better with ICS and soon Jelly
Bean, that I personally would be willing to take the risk, knowing that
I may not be able to replace a bricked phone under warranty. Often
times the phone isn't usually bricked though and if you use proper back
up and recovery techniques, you can in most cases recover your phone.
This isn't always true and never true if you didn't take the step to
backup the stock rom first or backup improperly. Rooting isn't
something I would take lightly as you may wind up buying another phone
out of contract and possibly a different phone.
