Yes if it keeps moving up it is, but the question is it it unstable or are you incidentally changing something with something else that then changes the setting. Most of the time the dock stays where people tend to put it in the sub menu. For example I tend to keep mine on the left side and it seems to stay there, thats why both you and I are both wondering why it's becoming a floating dock.
