Broadcasters, RIAA to appeal Net radio ruling

No one is happy with a June decision by the US Copyright Office and the Librarian of 
Congress on the rates webcasters are to be charged per song

According to a story by IDG News Service, both sides of the dispute over the rates 
Internet broadcasters will be expected to pay have said they will appeal the June 20 
decision handed down by the US Copyright Office and the Librarian of Congress.

The ruling by the Copyright Office has set royalty rates for music broadcast over the 
Internet at $0.70 per song, per 1,000 listeners (i.e. $0.70 x 10 songs per hour x 24 
hours x 365 = $61,320). At this level, only a handful of the stations currently on the 
air will still be in business after September when the rates are slated to be enforced.

Internet broadcasters already pay the same fees that traditional radio stations pay. 
The crux of the matter lies with the DMCA (Digital Millennium Copyright Act), which is 
the basis for forcing Internet broadcasters pay royalty fees twice.

The The Digital Media Association (DiMA), which is one of several groups contesting 
DMCA provisions in court that represents the interests of many Internet broadcasters, 
is still trying to conjole an intransigent RIAA to return to the negotiating table.
