Apple to Mac Community: We Will Sue
By Remy Davison, Insanely Great Mac
December 12th 2002
New civil suit against former contractor may point to a harder line being taken by
Cupertino
Apple has sent a strong message to the Mac rumor mongers: they will sue people who
reveal details of products in advance of their release. The news comes courtesy of a
civil suit filed against Jose Lopez, a former Apple contractor.
A ZDNet article argues that this implies Apple is getting serious about sending
signals to rumor sites to 'cease-and-desist' from revealing privileged information.
"They are clearly timing this to warn other potential leakers," IDC analyst Roger Kay
said to ZDNet. "You make the object lesson at the right moment."
The infamous 'worker bee' case of 2001 saw Apple file charges against one individual
who had published internal Apple materials on the internet.
According to the story, Apple alleges that Lopez made images of the then-forthcoming
Power Mac G4s available on the internet. The company is seeking legal fees,
compensatory and exemplary damanges and an injunction which would prevent Lopez from
revealing any other knowledge he had regarding future products.
Analysis: ZDNet and Kay see this a warning to rumor sites in the lead-up to MacWorld.
Would Apple sue publishers of Mac sites? If they were unable financially to defend
themselves (and that's most of them), maybe. If rumors appeard in an IDG publication -
as they do - probably not.
There's a fine line here: it is certainly unlawful for someone to break a
Non-Disclosure Agreement (NDA).
