I am sure it varies by state, but setting up an LLC is quite easy....

I did a search for my company name to see if it was available in my state (the 
state has a web site for this).

Downloaded and filled out the form, then took it to the courthouse with $35 in 
order to register.  Quite easy and you don't necessarily need a lawyer to 
register.

Your state probably has a web page that describes the process.

The only downside is that you will probably be paying for local, county, and 
state business licenses (because they now have you registered).  These cost 
more than the fee to create the LCC.

FYI, I live in Alabama.
