During one of my user interface consultations at WWDC I asked them about this, as one of our apps makes heavy use of Apple icons.
What they told me was that if you're using it in context, and referencing the image by path (not including them in your binary), that they had no problem with it. And in fact would rather that than people making bad knockoff images to use instead. Naturally this isn't legal advice, but I'm no longer afraid of using those images. The problem with referencing them by path is that paths sometimes change over time.
