I think folks don't need to worry about the preverbal ruler slap on the wrist.  The iPod was heavily modded, and the iPhone was even hacked to accept other service providers.  At this time I've never heard of Apple pursuing legal action.  In fact with the iPod hacks, most are now incorporated into the product and led to the application install features of the touch and iPhone.
