I do not use Spotlight but tried it just now. I hit escape to dismiss any search results and escape one more time to dismiss Spotlight.

That is correct.  The Finder cannot be closed, nor does it need to be.
Things like Spotlight are usually services, not apps, thus when you close
it, the Finder is still considered the running application, but focus is
not within the correct window.  The cmd-tab I mentioned will bring focus
back to the correct Finder window and you should be fine to proceed.

It's not really a bug.  It's due to layering.  When you open Spotlight,
an invisible layer brings the Spotlight service into focus, therefore, VO
works within the Spotlight layer.  When you close Spotlight, that layer
is still there.  The sighted user will not notice it as it is invisible,
and when they click an item visible to them on the screen, focus is
automatically transferred to the other app and the selected item.  With
VO, you can either press cmd-tab to make VO focus go back to the actual
Finder, or click the mouse or Trackpad to get focus out of the Spotlight
layer.
