Dear Sarai, I was able to confirm your experience with the inability of being able to close the Spell Check Window without having the message being sent.
If you change the settings in the Mail Preferences window, under the compose pane, you should be able to cure the problem. there are three selections in the pop up spell check window. One is "Never". the second is "While typing". The third is"Upon pressing the send button". If you change the spell check to either "Never" or "While Typing" you will be able to close the window by either command-w or VO-ESCAPE.. Once you do that you may bring the Spell check back up by pressing SHIFT-COMMAND-SEMICOLON or if the misspelled word is selected, I hope this helps.
