I would definitely take it in to the apple store if you have one near by. I have just had my iPhone 4 replaced at no charge. I do not have Apple care either. I had dropped my phone on concrete and the screen was completely shattered. The Apple rep said that it would normally be $179 to replace the phone but as I had not had any physical damage to the phone previously they would cover it under the normal 12 meh warrantee. I have heard on some of the tech podcasts that apple have a semi unofficial :we're Awsome" policy. Supposedly one of the criteria is that you don't lie to them. You just bring in the phone or whatever and tell them exactly what happened cause they'll know anyway. I guess this is more relevant with things like water damage then it is for dropping. There would be other criteria as well of course but I have heard lots of stories from friends etc about how Apple have gone above and beyond what they would have to. This has been with things like mine which were obviously user damage. With something like an ear piece not working properly, I would be extremely surprised if it cost you anything at all to get fixed. You would probably find that they would just take your old phone and go e you a new one. You could then look at selling the new iPhone 4 on eBay and using the money on a new iPhone 4S. I am just waiting to see how much the new iPhones are going to be on my works staff plan before deciding what to do.
