I only seem to have this issue in the status menus, or the "menu extras" as VoiceOver now calls them. It doeswn't happen all the time, but when it does, hitting Escape just dings at me. My only solutions at this point are to either Command-Tab out of and back into the application you're using, if you have multiple applications open, or move focus to the dock and press the button for the application you are busy with. I hope this can be fixed in a future update.
