Isn’t there a “Force Empty trash somewhere (poss. cmd+shift+e).  Also, another 
option is to quit whatever app is claiming ownership to that file, and then 
quit that app.  This happen to me the other day with pages running.  I then 
just quitted out of Pages, and, voila! was able to get rid of the file (eject 
will act the same way).
