same bug here with macbook (black). lspci shows:
02:00.0 Network controller: Atheros Communications, Inc. AR5418
802.11a/b/g/n Wireless PCI Express Adapter (rev 01)
on gentoo-kernel-2.6.23 with madwifi trunk revision 3092.
i try now "sudo iwpriv ath0 bgscan 0". i'll see if it helps.
