We already do that in other places, and starting it unconditionally lead to the question "the server is already running; do you want to restart it?" or something like that. Another reason why I used server-running-p. Just my 2c. Like I said, I don't care enough about Emacs 22 one way or the other as long as the version for >= 23 keeps checking server-running-p.
