You can consider that it's a bug if you wish and report it at <https://bugs.launchpad.net/mailman/+filebug>, but it is the intentional behavior. nonmember_rejection_notice is intended to be sent only with an automatic rejection due to reject_these_nonmembers or generic_nonmember_action = Reject.
