I just received spam from jeb...@cogzentappz.com sent via Constant Contact. Headers verify that it is indeed from Constant Contact. The spam was sent to an address that has never sent mail nor received any legitimate mail. The address appears to have been obtained by e-pending as the spam is personalized with my name.

The following is included in the footer of the spam itself:

"Note: This is a promotional email which complies with all of the guidelines of CAN-SPAM act 2003. We have found your email address through our own efforts on the web. If you find this email unsolicited, please reply with "REMOVE" in the subject line & we will take care that you don't receive any further promotional mail."

Here the spammer admits "We have found your email address through our own efforts on the web." Spammer follows this with "If you find this email unsolicited, please reply with "REMOVE"...." No kidding. First an admission that it's 100 percent unsolicited followed by noting that some people may find it so.

Is this now compliant with Constant Contact's current policy?
