I tried changing back to "classic" theme but still had the same issue. I took a screenshot:
http://www.screencast.com/t/nD01x5SX39I This happens on both my Macbook Pro and Mac Pro. Each have Font Explorer X Pro installed - I don't know if that makes a difference.
