I know jquery.
I think you can solve this problem in a different way.
Mapbuilder "fills" the legend div when it loads the widget, so the div
must be present when mapbuilder loads the legend widget, you cannot
create it after.
Two solutions:
1) hide that div indicated in the config and after copy the html of
the legend into the div you want, for example with an innerHTML or
some methods of jquery
or
2) position the that div in another place dinamically
