I want to thank everyone for their responses. I got a few very useful responses and here are the results:
There are 2 thematics for points data, one is "Point Ranges" and the other "graduated". It seems that the legend for "graduated" has only 3 symbols in the legend but that the data once mapped shows a variety of gradations. That is the thematic that I originally used. Someone pointed out the Point Ranges thematic which has much more flexibility and also creates graduated symbols, I switched my thematic to the Point Ranges and was able to show my legend as necessary and was able to change color for each range. A much more useful thematic if you ask me.
