ok looks like I need to give you a more information on the data..

the original table is a read-only CD - that is correct and contains several thousand 
records - I'm interested in about 10
I use the query->select function to build the query and select the records I need to 
work with in this case 'query2'
once I've created my selection I then go to file->save copy as...
and select my query - 'query 2'
the error message is "unable to create new table"

I just redid the steps I went through to make sure I wasn't missing anything.
So what am I doing that isn't correct??

  You should be able to save the query, using "Save Copy As", if you select the Query, 
at the bottom of the file list if it was your most recent query.  It seems that you 
may be trying to save the original file, which being open cannot be saved as itself.
