I'm using qgis 1.9 from a while back (before the vector branch merge). It shows wms layer names in the maplegend (toc).
As to arcgis server it now has an option to use layer names as they appear in the map project, effectively making names equal to the titles, even if illegal. But seriously, I can't imagine why this restriction is in the wms spec... seems archaic to me... Anyway, MapServer encoding layers also doesn't seem to make sense too... maybe something to consider in a future release?
